FEMA, NRO/NRE, Power of Attorney, repatriation, taxes.
Quick answer
NRIs can buy residential and commercial property in Pune without RBI permission. Purchase via NRO or NRE account. Use a specific (not general) Power of Attorney executed in your country of residence and apostilled.
NRO vs NRE
Both are acceptable for property purchase. NRE proceeds repatriate freely (cap: two residential properties per FY per NRI). NRO proceeds repatriate up to USD 1M per FY with Form 15CA/15CB.
Power of Attorney workflow
Draft a specific PoA naming a trusted India-resident. Notarise in your country. Apostille (Hague Convention) or get attested by the Indian embassy. Send original to India for sub-registrar registration.
TDS and tax
Buyer deducts 1% TDS on properties >₹50L. NRI sellers face higher TDS (typically 22.88% on long-term gains, 38.6% on short-term). File Form 27Q for NRI TDS.
